MIAMI — After nearly a year in U.S. immigration custody, prominent Haitian businessman Dimitri Vorbe could soon have an opportunity to regain his freedom, following a significant ruling by a federal judge in Miami ordering immigration authorities to provide him with a bond hearing.

According to the Miami Herald, U.S. District Judge Darrin P. Gayles ordered immigration authorities to provide Vorbe with a bond hearing by August 24, ruling that the government cannot continue holding him indefinitely simply because Secretary of State Marco Rubio determined that his presence in the United States could pose a risk to U.S. foreign policy.

If immigration authorities fail to provide the required hearing by the August 24 deadline, the judge ordered that Vorbe be released under reasonable conditions of supervision.

The ruling does not mean Vorbe has already been granted bond or that his release is guaranteed. Rather, it gives him something his attorneys have been seeking for months: an opportunity to argue that he should be allowed to leave detention while his immigration case continues.

Vorbe, 52, has been held in Immigration and Customs Enforcement (ICE) custody since September 2025, when federal agents detained him outside his South Miami home. He had entered the United States in January 2020 with a valid U.S. visa.

A Detention Based on Foreign-Policy Grounds

Vorbe’s detention stems from an unusual provision of U.S. immigration law involving foreign-policy considerations. Secretary of State Marco Rubio determined that Vorbe’s presence in the United States could have adverse foreign-policy consequences.

The U.S. government has accused the Haitian businessman of involvement in activities that contributed to Haiti’s destabilization, including alleged support for gangs. Vorbe and his attorneys have strongly denied the allegations and have challenged the government’s justification for keeping him detained.

The businessman has not been ordered removed by an immigration judge, and his attorneys have repeatedly challenged the government’s ability to keep him in custody for such an extended period without giving him an opportunity to seek bond.

Federal Judge Rejects Mandatory Detention Argument

The latest ruling represents an important victory for Vorbe’s legal team.

The Trump administration had argued that Vorbe could be held under mandatory detention because the secretary of state had invoked foreign-policy grounds in seeking his removal. Judge Gayles rejected that position, concluding that the circumstances did not permit the government to keep Vorbe indefinitely detained without an opportunity for a bond hearing.

The ruling does not resolve the government’s underlying effort to remove Vorbe from the United States. Instead, it addresses a separate and important question: Can the government continue holding him while his immigration proceedings remain unresolved without allowing him to seek release?

The federal court’s decision now gives Vorbe the opportunity to make his case for release.

Bond Hearing Could Open the Door to Freedom

The next major development will therefore be Vorbe’s bond hearing.

At that proceeding, the issue will shift from whether Vorbe has the right to request bond to whether he should actually be released while his immigration case moves forward. A favorable decision could allow him to leave detention under conditions imposed by immigration authorities.

Importantly, the federal judge established a firm deadline: Vorbe must receive the bond hearing by August 24. If immigration authorities fail to provide it by then, he must be released under reasonable conditions of supervision.

That makes the coming days potentially decisive after months of legal battles over his detention.

A High-Profile Case With Roots in Haitian Politics

Vorbe is a well-known member of one of Haiti’s prominent business families and previously headed SOGENER, an electricity company that became embroiled in a bitter dispute with the administration of late Haitian President Jovenel Moïse.

His immigration case has attracted considerable attention in Haiti and within the Haitian diaspora because of both his prominence and the unusual foreign-policy grounds being used by the U.S. government.

After nearly a year in ICE custody, the latest federal court ruling marks a significant turning point.

Unless the order is changed or successfully challenged, Vorbe must now receive an opportunity to seek bond by August 24 — bringing him closer to the possibility of release than at any point during his months-long detention.

Whether he actually walks free will depend on the outcome of the bond hearing. But for Vorbe and his legal team, the ruling opens a potentially important path toward release after nearly a year behind bars.
